3. Early Access Program

eavie's Early Access program is designed to allow a limited group of users to experience eavie while we test, learn, and improve the Platform.

During Early Access, we may analyze information about how users interact with eavie, including product usage, technical performance, feature engagement, and other information described in this Privacy Policy.

This information helps us understand how eavie performs in real-world use and helps us improve the Platform before and during wider availability.

Feedback

We may invite Early Access users to provide feedback about their experience.

Providing feedback is optional unless we specifically tell you that participation in a particular research activity is required.

Feedback you voluntarily provide may be used to improve, develop, test, and evaluate eavie.

4. Consent

We seek meaningful consent for the collection, use, and disclosure of personal information in accordance with applicable privacy laws.

The form of consent we use depends on the sensitivity of the information and the circumstances in which it is collected.

For information that is not sensitive and is reasonably expected as part of using eavie, consent may be obtained through the applicable account, Early Access, or Platform flow.

For sensitive information, including biometric information, we use express consent.

You may withdraw consent where permitted by law, subject to legal or contractual restrictions and reasonable notice.

If you withdraw consent for information that is necessary to provide a particular feature or service, that feature or service may no longer be available to you.

5. Biometric Information and Facial Verification

5.1 What We Collect

eavie uses facial verification technology, currently provided by Amazon Web Services (AWS) Rekognition, to support identity and safety features.

During verification, eavie may capture an image of your face and process it to perform liveness detection and facial verification.

This may generate biometric information, facial geometry data, verification results, or related information.

5.2 Why We Use It

Facial verification may be used to:

  • Help verify that you are a real and unique individual;
  • Help prevent impersonation and fraudulent accounts;
  • Perform liveness detection to help prevent spoofing using photographs, videos, or other attempts to impersonate a person; and
  • Before an in-person meeting arranged through eavie, help confirm that the person attending the meeting corresponds to the verified profile.

5.3 Express Consent

Because biometric information is sensitive, eavie requires express, opt-in consent before biometric verification is performed.

The biometric consent process is separate from general acceptance of these Terms and this Privacy Policy.

You may withdraw biometric consent at any time, subject to applicable law and the practical consequences described below.

5.4 Consequences of Withdrawal

Facial verification is an important part of eavie's trust and safety system.

If you withdraw consent for biometric verification, you may not be able to maintain an eavie account or use features that require identity or meeting verification.

5.5 Storage and Security

The reference facial information used for verification is stored using security measures appropriate to its sensitivity.

Where eavie stores reference facial information on its own infrastructure, it is stored in an access-restricted environment with appropriate encryption and security controls.

Biometric information is not displayed to other eavie users.

5.6 Retention

eavie retains biometric information only for as long as reasonably necessary for the purposes described in this Privacy Policy and in accordance with applicable legal requirements.

Our current retention approach is to retain Face ID data while your account is active and for approximately 30 to 90 days following account deletion, where necessary to help prevent fraudulent re-registration, after which it is permanently deleted.

Retention periods may be updated as our systems and legal requirements evolve.

5.7 No Secondary Use

eavie does not sell biometric information.

We do not use Face ID data for purposes unrelated to the facial verification purposes described in this Policy.

We do not provide raw biometric information to other eavie users.

6. Location Information

eavie uses location-based services, including the Google Places API, to provide features such as discovering nearby activities, venues, and experiences.

Where a feature requires device location, we may request permission to access your approximate or precise location.

You can control location permissions through your device settings.

Disabling location access may limit or disable features that depend on location.

Consistent with the applicable Google Places API requirements and our current product design, eavie may retain latitude and longitude information for up to 30 days and cache certain venue information for up to 24 hours, after which it may be refreshed or deleted.

7. How We Share Personal Information

We may disclose personal information in the following circumstances.

7.1 Service Providers

We may use third-party service providers to process information on our behalf, including providers supporting:

  • Cloud hosting
  • Data storage
  • Analytics
  • Authentication
  • Communications
  • Application infrastructure
  • Location services
  • Facial verification
  • Security
  • Customer support

These providers may process personal information only as reasonably necessary to provide their services to eavie.

7.2 Other Users

eavie is a social platform.

Information you choose to include in your profile or share through the Platform may be visible to other users.

This may include:

  • Name
  • Profile photo
  • Bio
  • Interests
  • Activities
  • Cravings
  • Moments
  • Other information you choose to share

Where relevant, eavie may display confirmation that a user has completed required verification.

We do not provide your raw biometric information to other users.

7.3 Legal and Safety Requirements

We may disclose personal information where required or permitted by applicable law, including where reasonably necessary to:

  • Comply with a legal obligation;
  • Respond to a lawful request;
  • Protect the rights, property, or safety of eavie or another person;
  • Investigate fraud, abuse, or security incidents; or
  • Enforce our Terms of Use.

7.4 Business Transfers

If eavie is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, personal information may be transferred as part of that transaction, subject to applicable privacy requirements and appropriate safeguards.

8. International Processing

eavie is based in Canada, and certain personal information may be processed or stored by third-party service providers outside Canada.

Where information is processed outside Canada, it may be accessible to courts, law enforcement agencies, or national security authorities in those jurisdictions under applicable law.

We use contractual, technical, administrative, and organizational safeguards appropriate to the sensitivity of the information.

9. Data Storage and Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, collection, use, disclosure, alteration, loss, or destruction.

The safeguards we use may include:

  • Access controls
  • Encryption
  • Restricted infrastructure access
  • Authentication controls
  • Monitoring
  • Secure storage
  • Technical safeguards appropriate to the sensitivity of information

No method of electronic transmission or storage is completely secure.

10. Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, operate the Platform, maintain appropriate records, address security concerns, resolve disputes, and comply with legal obligations.

When information is no longer reasonably required, we will take reasonable steps to delete, destroy, or anonymize it, subject to applicable legal requirements.

Specific retention periods may apply to certain information, including biometric and location information, as described elsewhere in this Policy.

11. Your Privacy Rights

Subject to applicable law and limited exceptions, you may have the right to:

  • Request access to personal information we hold about you;
  • Request correction of inaccurate or incomplete information;
  • Withdraw consent where permitted;
  • Request deletion of your account and personal information, subject to applicable legal requirements;
  • Ask questions about how your information is collected, used, or disclosed; and
  • Make a privacy complaint.

To exercise your privacy rights, contact our Privacy Officer at:

privacy@eavie.co

If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.

12. Marketing Communications

eavie may ask whether you would like to receive updates about:

  • eavie product updates;
  • Early Access opportunities;
  • Events;
  • Announcements;
  • New features; and
  • Other promotional communications.

Marketing communications are separate from communications necessary to provide or operate your account.

Where consent is required, we will obtain the appropriate consent before sending commercial electronic messages.

You can withdraw marketing consent at any time through the unsubscribe mechanism included in the message or by contacting us.

Withdrawal of marketing consent will not prevent us from sending important service-related communications.

13. Slack and Early Access Community

eavie's Early Access program may use Slack as a community and communication platform.

If you join the eavie Early Access Slack community, information you provide or make available through Slack may be processed by Slack according to Slack's own terms and privacy practices.

You should review Slack's applicable policies before using the service.

Slack is a communication and community layer for Early Access and is not the eavie Platform itself.

14. Children and Minors

eavie's Early Access program and Platform are intended for individuals 18 years of age or older.

We do not knowingly permit individuals under 18 to participate in the Early Access program.

If we become aware that an individual under 18 has provided personal information in connection with the Early Access program, we may take reasonable steps to delete that information.

15. Cookies and Similar Technologies

eavie may use cookies, analytics tools, software development tools, and similar technologies to operate, secure, measure, and improve the Platform.

For additional information, see our Cookie Policy: eavie.co/cookies

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to:

  • eavie's products or services;
  • our data practices;
  • third-party services;
  • applicable laws; or
  • our privacy and security practices.

Where required, we will provide notice of material changes through email, the Platform, our website, or another appropriate method.

The updated Policy will include a revised "Last Updated" date.
